Article 1. Privacy Policy for Members

The purpose of this Privacy Policy (hereinafter referred to as the “Policy”) is to inform Members about which of their personal data will be processed by Sport Break and how, in connection with their Membership under these Terms and Conditions.

This Policy, as well as the processing of Members’ personal data, is governed by generally binding legal regulations, in particular Act No. 110/2019 Coll. on the Processing of Personal Data, and Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons regarding the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation, “GDPR”).

Sport Break processes Members’ personal data solely for the purpose of fulfilling the purpose of processing, to the necessary extent, and for the necessary duration.

Each Member, by agreeing to these Terms and Conditions, gives explicit consent to the processing of their personal data in accordance with this Policy, prior to ordering and paying for the Membership.

Each Member, prior to ordering and paying for the Membership under these Terms and Conditions, has declared that they are over 18 years of age. Sport Break therefore does not process the personal data of persons under the age of 18.

Sport Break processes Members’ personal data based on their consent to the Terms and Conditions, for the purpose of providing its services, communicating with Members, and fulfilling legal obligations.

For account management purposes, the following Member data is processed:

For communication between Sport Break and Members and for marketing purposes, the following data is processed:

Sport Break processes the following personal data of Members:
a. First name
b. Last name
c. Date of birth
d. Address of residence (street, building or orientation number, postal code, city, and optionally country)
e. Phone number
f. Email address
for the purposes stated in this Policy. -
Sport Break also processes the following indirect data of Members:
a. IP address
b. Cookies (for the purpose of offering relevant content only to Members and facilitating website navigation)
c. Information about browser and operating system version to ensure proper website display -
Sport Break processes the personal data of Members for the duration of the Membership.
Upon termination of Membership, Sport Break is obliged to erase the Member’s personal data and cease any further processing, unless the obligation to retain the data even after the end of the Membership arises from valid and effective legal regulations, in particular:-
Act No. 499/2004 Coll. (on archiving and records management and on amendments to certain acts),

Act No. 110/2019 Coll. (on personal data processing), and
-
Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and the free movement of such data, repealing Directive 95/46/EC (General Data Protection Regulation, “GDPR”).

Members have the following rights regarding their personal data:
a) Right to withdraw consent to the processing of personal data
The Member may withdraw their consent to the processing of personal data by:-
sending an email to Sport Break at: info@sportbreak.cz,
-
sending a registered letter to the company’s registered office,
-
or by another similar method.
The Member must explicitly state in the withdrawal notice that they are withdrawing consent to personal data processing.
In such case, Sport Break is obliged to stop processing the Member’s personal data without undue delay, but no later than 5 days from the receipt of the withdrawal notice, unless the obligation to continue processing arises from valid and effective legal regulations.
The contractual relationship between Sport Break and the Member, established by the Membership, shall be terminated upon delivery of an email notification from Sport Break to the Member confirming: -
the cessation of data processing, and
-
the termination of the Membership.
b) Right of access to personal data and the right to correct or supplement them
The Member may request from Sport Break:-
confirmation of whether their personal data is being processed,
-
and if so, what data is being processed and how.
This can be done by: -
sending an email to info@sportbreak.cz,
-
sending a registered letter to the company’s registered office,
-
or using another similar method.
Sport Break is obliged to provide the requested information.
The Member may also request correction of inaccurate data or supplementation of incomplete data, and Sport Break is obliged to make such changes.

c) Right to request restriction of processing
The Member may request that Sport Break restrict the processing of their personal data by:
-
sending an email to info@sportbreak.cz,
-
sending a registered letter to the company’s registered office,
-
or by another similar method,
provided the conditions for such restriction are met under generally binding legal regulations.
If such conditions are met, Sport Break is obliged to restrict the processing accordingly.
d) Right to object to processing
The Member has the right, on grounds relating to their particular situation, to object at any time to the processing of personal data concerning them.
e) Right to lodge a complaint with a supervisory authority
The Member has the right to lodge a complaint with a supervisory authority.
If the Member is in any way dissatisfied with the processing of their personal data by Sport Break, they may file a complaint:

directly with Sport Break (via email to info@sportbreak.cz, by registered letter to the company’s registered office, or in another similar way),
-
or contact the Office for Personal Data Protection (Úřad pro ochranu osobních údajů – CZ).
f) Right to data portability
The Member may request from Sport Break the personal data they have provided, in a standard machine-readable format, by:

sending an email to info@sportbreak.cz,
-
sending a registered letter to the company’s registered office,
-
or another similar method.
Sport Break is obliged to provide the requested personal data in the specified format.
The Member may then: -
transfer the data to another data controller,
-
or (if technically feasible) request Sport Break to transfer the data directly to another controller.
Article 2. Privacy Policy for Analysts

The purpose of this Privacy Policy is to inform the Analyst about which of their personal data will be processed by the Company and how, in connection with their Activity under these Terms.

This Policy, as well as the processing of personal data of Analysts, is governed by generally binding legal regulations, in particular Act No. 110/2019 Coll. on the Processing of Personal Data, and Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons regarding the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation, “GDPR”).

The Company processes the personal data of the Analyst solely to fulfill the purpose of processing, to the necessary extent, and for the necessary period.

By agreeing to these Terms, each Analyst explicitly consents to the processing of their personal data in accordance with this Policy, prior to commencing cooperation under these Terms.

Each Analyst, prior to commencing cooperation under these Terms, declares that they are over 18 years of age. Therefore, the Company does not process personal data of individuals under 18.

The Company processes personal data of Analysts based on their consent to the Terms, for the purpose of performing their Activity, communicating with Analysts, and fulfilling legal obligations.

For the purpose of recording the Analyst’s Activity, the following data is processed:

The Company processes the personal data of Analysts for the duration of the cooperation.
After the cooperation ends, the Company is obliged to erase and cease processing the Analyst’s personal data, unless the obligation to retain the data even after the end of the cooperation arises from valid and effective legal regulations, especially:

Act No. 499/2004 Coll. (on archiving and file service),

Act No. 110/2019 Coll., and
-
Regulation (EU) 2016/679 (GDPR).
1. Right to withdraw consent to the processing of personal data
The Analyst may withdraw their consent by:

sending an email to the Company at: machac@sportbreak.cz,

sending a registered letter to the Company’s registered office,
-
or by another similar method.
In the withdrawal notice, the Analyst must explicitly state that they withdraw their consent to the processing of personal data.
In such case, the Company is obliged to stop processing the Analyst’s personal data without undue delay, but no later than 20 days from receiving the withdrawal notice, unless continued processing is required by valid and effective legal regulations.
The contractual relationship between the Company and the Analyst, based on their cooperation, shall terminate upon delivery of an email notification from the Company to the Analyst, confirming the cessation of data processing and the end of cooperation.
2. Right of access to personal data and the right to correct or supplement them
The Analyst may request confirmation of whether their personal data is being processed, what data is involved, and how it is being processed, by:

sending an email to machac@sportbreak.cz,
-
or sending a registered letter to the Company’s registered office,
-
or by another similar method.
The Company is obliged to provide this information.
The Analyst may also request corrections of inaccurate data or supplementation of incomplete data by the same means, and the Company is obliged to comply.
3. Right to request restriction of processing
The Analyst may request the Company to restrict the processing of their personal data, provided the conditions for such restriction are met under applicable legislation.
This can be done via email, registered letter, or other similar means.
If the legal requirements are met, the Company is obliged to restrict processing accordingly.
4. Right to object to processing
The Analyst has the right, on grounds relating to their particular situation, to object at any time to the processing of personal data concerning them.
5. Right to lodge a complaint with a supervisory authority
If the Analyst is dissatisfied with the way their personal data is processed by the Company, they may lodge a complaint:
-
directly with the Company (via email to machac@sportbreak.cz, or by registered letter to the Company’s address),
-
or with the Office for Personal Data Protection.
6. Right to data portability
The Analyst may request the Company to provide the personal data they have submitted in a common and machine-readable format by:

sending an email to machac@sportbreak.cz,
-
or a registered letter to the Company’s office,
-
or another similar method.
The Company is obliged to provide the requested data in the specified format.
The Analyst may then transfer this data to another data controller, or (if technically feasible) request that the controllers transfer the data between themselves.
